GRAND NORDIC ACKNOWLEDGEMENT AND ASSUMPTION OF RISK Please read carefully before signing. This is a release of liability and waiver of certain legal rights. I understand the nature of Nordic skiing and Nordic Ski activities and I, or my child *, is qualified, in good health, and in proper physical condition to participate in such activities that involve inherent dangers and risks. I willingly and voluntarily accept these risks and elect to participate in the event. By my signature below, I agree to accept the full responsibility for my actions and risks, release any liability, and surrender any rights to seek reimbursement from Grand Nordic and any of its agents. I authorize Grand Nordic and medical personnel on hand to call for medical care for the participant or to transport participant to a medical facility or hospital if, in their opinion, medical attention is needed. This agreement shall be governed by the laws of the State of Colorado. I understand that any equipment provided by Grand Nordic is and remains the property of Grand Nordic, and agree to return this equipment to Grand Nordic at the end of the event. All events will observe Covid19 restrictions as imposed by the Grand County Health Dept. However, we cannot guarantee that no risk is involved. We understand that quarantining is often necessary if exposed to Covid19 prior to our event or other medical issues that may arise. If sick, we request that you advise us ASAP in advance to qualify for a refund and to allow us to accept another participant. Snow Mountain Ranch Nordic Center Waiver In consideration for the rights and privileges associated with participation in a YMCA of the Rockies Snow Mountain Ranch event, I acknowledge and agree to be bound by the following: 1. Identification of Risks. I understand that participation in any skiing activity, including but not limited to, preparation for, participation in, and coaching of activities in cross country ski competitions and clinics, involve risk of serious injury, including permanent disability, death and other losses, due to inactions or negligence of myself or others. 2. Assumption of the Risk. I agree that I am responsible for my safety while participating in activities associated with YMCA of the Rockies Snow Mountain Ranch, and that such responsibility includes participation only; a) when I am both physically and psychologically prepared to participate safely, b) after fully familiarizing myself with the venue before beginning the activity, and c) while using the equipment of a type and condition reasonably necessary to safely participate. I assume all risk connected with responsibility for any injury or loss connected with my participation. 3. Waiver. Aware of the risks and willing to assume them, I hereby waive, release and agree to hold harmless the YMCA of the Rockies Snow Mountain Ranch, its affiliates, subsidiaries, officers, directors, employees, agents, coaches, trainers, doctors, officials, event organizers or sponsors (Released Parties) from any and all claims by me for any liability, injury, loss or damage in any way connected with my participation in activities associated with YMCA of the Rockies Snow Mountain Ranch, except where caused by the gross negligence or willful or wanton misconduct of any of the Released Parties. I intend for this waiver and release to also apply to any relatives, personal representatives, heirs, beneficiaries, next of kin or assigns who may pursue any legal action or claim on my behalf. 4. I hereby grant permission to the YMCA of the Rockies, and its authorized representatives, to record my likeness, including in the form of photographs, videos, or other depictions of my likeness (collectively, my “Image”), and my written or spoken statements, including interviews of me (collectively, my “Statements”), during the time I am on the premises of the YMCA of the Rockies or attending or participating in events produced or sponsored by the YMCA of the Rockies. I hereby grant permission to the YMCA of the Rockies to use my Image, Statements, and name in all forms and media, without any restrictions as to changes, alterations or derivatives of any type, in any manner as the YMCA of the Rockies deems appropriate for any lawful purpose. I understand that my name, Image, and Statements may be included in print, video, audio, electronic, online or other communications by YMCA of the Rockies and that such information may be distributed to the public. I hereby waive any claims I may have based on any use of my name, Image, or Statements, including without limitation, invasion of privacy, publicity, false light, libel, slander or defamation. I understand that this release in no way obligates the YMCA of the Rockies to use my name, Image or Likeness. 5. I hereby authorize YMCA of the Rockies and its authorized representatives (including photographers, production companies, television stations, advertising agencies, and publishers) to record my child’s likeness (including in the form of photographs, videos, or other depictions) and to use my child’s likeness in all forms and media, without any restrictions, in any manner as the YMCA of the Rockies deems appropriate for purpose of advertising, promotion, or other lawful use relating to the YMCA of the Rockies.
