Please Read Carefully Before Signing <<<<< Release and Indemnification In consideration of the permission granted to me by The Coastal Challenge to participate in an Expedition Event or Adventure Tour (the "Activity") in Costa Rica (The "Site"), I, the undersigned (or legal guardian, if minor), agree as follows: 1. I understand the term Site includes any locale within the Country of Costa Rica including any activity involving travel to and from the Site. 2. I FULLY RECOGNIZE THE DANGERS OF PARTICIPATING IN THE ACTIVITY, AND I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH MY PARTICIPATION. The dangers that I may encounter include, by way of example only and without limitation: venomous and non-venomous snakes, rugged and steep terrain, wild animals, slippery rocks, cliffs, cactus spines, bees, harsh and quickly changing weather conditions. I realize that there is risk of my becoming seriously ill or injured in an area remote from medical care and that The Coastal Challenge cannot guarantee the availability of emergency medical services or emergency transportation to medical health facilities. 3. I have been properly instructed in and understand the use of any equipment I am to use in the Activity. I realize that my participation in the Activity may require sustained strenuous physical activity. I am in good health and am not aware of any physical or medical condition that might endanger myself or other participants in the Activity. 4. ACTING FOR MYSELF AND MY HEIRS, PERSONAL REPRESENTATIVES, EXECUTORS, ASSIGNS AND GUARDIANS AD LITEM, I HEREBY RELEASE AND HOLD HARMLESS The Coastal Challenge AND EACH OF THEIR AGENTS, REPRESENTATIVES, VOLUNTEERS, EMPLOYEES, CONTRACTORS, OFFICERS, DIRECTORS AND SHAREHOLDERS (COLLECTIVELY REFERRED TO AS "AGENTS") FROM ANY AND ALL CLAIMS AND LIABILITY FOR INJURY TO OR DEATH OF ANY PERSON, PROPERTY, INCLUDING MY OWN, ARISING FROM OR RELATED TO MY PARTICIPATION IN THE ACTIVITY OR DURING THE TRAVEL TO OR FROM THE SITE WHETHER OR NOT ARISING FROM NEGLIGENCE. 5. ACTING FOR MYSELF AND MY HEIRS, PERSONAL REPRESENTATIVES, EXECUTORS, ASSIGNS AND GUARDIANS AD LITEM, I AGREE NOT TO MAKE A CLAIM AGAINST, SUE OR ATTACH THE PROPERTY OF THE COASTAL CHALLENGE AND/OR THEIR AGENTS FOR INJURY OR DAMAGE RESULTING FROM THE NEGLIGENCE OR OTHER ACTS OR OMISSIONS, HOWSOEVER CAUSED BY THE COASTAL CHALLENGE AND ITS FOUNDATION, AND THEIR AGENTS ARISING FROM MY PARTICIPATION IN THE ACTIVITY OR DURING MY PRESENCE ON OR TRAVEL TO AND FROM THE SITE. I FURTHER AGREE TO INDEMNIFY AND DEFEND AND HOLD HARMLESS THE COASTAL CHALLENGE AND THEIR AGENTS FROM ANY AND ALL CLAIMS AND LIABILITIES FOR INJURY TO OR DEATH OF THE UNDERSIGNED, AND FOR DAMAGE TO OR THE LOSS OR DESTRUCTION OF PROPERTY OF THE UNDERSIGNED ARISING FROM MY PARTICIPATION THE ACTIVITY OR DURING MY PRESENCE ON OR TRAVEL TO AND FROM THE SITE WHETHER OR NOT ARISING FROM THE NEGLIGENCE OR OTHER ACTS OR OMISSIONS OF THE COASTAL CHALLENGE AND/OR THEIR AGENTS. <6. I EXPRESSLY AGREE THAT NO WARRANTY OR REPRESENTATION OF ANY KIND WHATSOEVER HAS BEEN GIVEN REGARDING THE CONDITION OF THE SITE OR ANY FACILITIES OR EQUIPMENT THEREON OR ANY MEANS OF TRANSPORTATION TO AND FROM THE SITE, AND AGREE, FURTHERMORE, THAT THE COASTAL CHALLENGE AND THEIR AGENTS SHALL NOT BE LIABLE FOR ANY ALLEGED NEGLIGENCE OR OTHER ACTS OR OMISSIONS PERTAINING THERETO. <7. I ASSUME FULL LIABILITY FOR ANY INJURY TO OR DEATH OF ANY PERSON ARISING BY REASON OF MY PARTICIPATION IN THE ACTIVITY, PRESENCE ON THE SITE OR TRAVEL TO AND FROM THE SITE OR FOR ANY DAMAGE TO OR LOSS OR DESTRUCTION OF THE PROPERTY ON THE SITE CAUSED BY ME. I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ALL OF ITS CONTENTS AND LEGAL EFFECT. Photo Release Form for The Coastal Challenge, LLC I hereby give the The Coastal Challenge irrevocable rights and permissions, in connection with the photographs/negatives/videos/digital images taken of me during the event, or images in which I may be included with others, the following: a) The right to use and reuse, in any manner at all, said photographs/negative/digital images/video and film footage, in whole or in part either by themselves or in conjunction with other photographs/negative/digital images/video and film footage in any medium and for any purposes whatsoever, including all promotional and advertising uses as well as using my name in connection therewith if it is so desired; and b) The right to copyright said photographs/negative/digital images/video and film footage in the name of The Coastal Challenge. I hereby forever release and discharge the Coastal Challenge from any and all claims, actions and demands arising out of, or in connection with, the use of said photographs/negative/digital images/video and film footage including, without limitations, any and all claims for invasion of privacy and libel. This release shall insure to the benefit of the assignees, licensees and legal representatives of The Coastal Challenge as well as the party(s) for whom the photographs/negative/digital images/video and film footage were taken. I represent that I am over the age of 18 and that I have read the forgoing and fully and completely understand the contents hereof.
