Liability Release Form
In this document: Organisation means: Floreat Surf Lifesaving Club and Surf Life Saving Western Australia Inc.
Event means: Indian Ocean Open Water Swim Event, Sunday 3rd December 2023
Release
1. The Participant expressly understands, acknowledges, and agrees that participation in the Event may involve activities that have the potential to cause harm to the Participant, including personal injury and/or death.
2. By signing this release, the Participant:
(a) voluntarily assumes the risk of personal injury or death which the Participant may suffer due to his/her participation in the Event; and
(b)releases and indemnifies the Organisation (including the Organisation’s members, employees, officers, contractors, and agents) from and against all liability, cost and damage arising from the Participant’s participation in the Event, including in respect of any personal injury or death suffered by the Participant including personal injury or death that is suffered as a consequence of the Organisation’s negligence.
3. I declare that I am medically, mentally, and physically fit and able to participate in the Event. I will immediately notify the Event Organiser in writing of any change to my medical condition, fitness, or ability to participate in the Event. I understand and accept that the Organisation will continue to rely upon this declaration as evidence of my fitness and ability to participate in the Event. If I am, or become, unwell in any way I will (a) immediately leave the Event if I am already at the event venue; or (b) not attend the Event and will not attend such until I am cleared by a medical practitioner to do so.
4. If the Participant is under 18 years of age:
(a) This release must be signed by a parent or guardian legally entitled to enter into this release on behalf of the Participant; and
(b)The parent or guardian that signs this release expressly:
a. consents to the Participant participating in the Event;
b. consents to the Organisation providing first aid and obtaining emergency medical treatment for the Participant if necessary; and
c. agrees to accept financial responsibility for costs related to any medical and emergency medical treatment.
